Pearl of Africa Hotel sued over failure to pay for wines, spirits worth Shs51 million

Pearl of Africa Hotel has been sued for alleged failure to pay for wines, spirits, whiskeys and champagnes worth more than Shs51m.

The upscale hotel was sued by Uganda Duty-Free Sales before the Commercial Court in Kampala on March 5.

The company contends that between August 11, 2017 and December 2017, they supplied to the hotel assorted drinks but Pearl of Africa Hotel has since refused to pay.

“The wines, spirits, whiskeys and champagnes supplied to the defendant totalled to Shs51.9m. the defendant through their agent acknowledged receipt of the supplied products by signing and stamping each particular invoice for each particular supply,” documents before court read in part.

Uganda Duty-Free Sales claims that after supplying the products, it demanded pay but to date, Pearl of Africa Hotel has refused, failed and or neglected to honour its obligations.

They also claim that despite several reminders, Pearl of Africa has remained adamant to settle the debt.

Through their lawyers of Mugume Advocates, the company avers that it has continued to suffer a loss of income as a result of the hotel’s willful default despite being reminded through demand notice.

Court has now issued summons against Pearl of Africa Hotel to defend its self on allegations of failing to pay the said amount of money.

According to the summons issued by the Commercial Court registrar Mr Festo Nsenga on March 7, Pearl of Africa Hotel is required to defend its self within 10 days from the date of service.

“Whereas Uganda Duty-Free Sales has instituted a suit against you upon the claim particulars of which are set out in the copy of the plaint… you are hereby required to file a defence within 15 days from the date of service of summons on you…” the summonses read in part.
