Court lifts ban on Eddy Kenzo performances in Kampala

Ugandan Grammy Awards nominee Eddy Kenzo is finally free to entertain his fans in Uganda after the court vacated the interim order that they had issued following the Luba Events’ case against the artist.

Moses Lubuurwa alias Luba events dragged the ‘Tweyagale’ singer to court in November after his successful ‘Eddy Kenzo festival, accusing him of breaching a contract they had agreed upon of organizing the Festival. Luba explained that he had incurred a loss of 800m which he had invested in the festival in 2020. The festival had been put on hold due to the covid-19 pandemic. He, therefore, wanted the court to ban Eddy Kenzo from performing in any place in Uganda until he performs for him.

Eddy Kenzo, who is currently out of the country was represented by Counsel Kabega Musa and Counsel Faisal Balikurungi of Kabega, Bogezi, and Bukenya Advocates who objected to the court’s decision, explaining that Moses had filed a miscellaneous application.

They cited that there was no resolution authorizing Moses Lubuurwa to institute the suit, the prayers sought in the application were vague and untenable, the application was overtaken by events as all shows had taken place, and also that the court order was against public policy and would amount to an unreasonable restraint of trade. “Court upheld all the above objections and dismissed the application with Costs,” reads part of the statement shared on Eddy Kenzo’s social media after he got cleared.

The statement also explains that Luba Events had deposited 40m to Eddy Kenzo and not 120m as he alleges. “The 40m was used in preparations for the events in rehearsals, costuming, and other related costs. The total expenditure of Luba Events on this event was 146m as he submitted to the court,” reads the statement.

Luba events was also one of the event’s organisers who were compensated by the government over cancelled events. He was compensated with 450M through the Uganda National Cultural Centre (UNCC).
